Article 1. Application of the General Terms & Conditions

1.1  On all offers, orders and agreements of only the 08TO80 General Terms and Conditions are apropriate. These General Terms and Conditions have been filed with the Chamber of Commerce in Amsterdam. On request we will send our General Terms and Conditions digitally.

1.2 Accepting an offer or placing an order at means that you agreed upon the applicability of these General Terms and Conditions.

1.3 All rights and claims, as described in these General terms and Conditions and any further agreements for are stipulated, are also stipulated by enabled for intermediaries and other third parties.

Article 2. Offers/Agreements

2.1 All offers are without obligation and reserves the right to change prices, especially when based on (legal) regulations.

2.2 A contract is only valid after acceptance of your order by 08TO80. 08TO80 has the right to refuse orders/agreements or conclude certain conditions to the delivery, unless otherwise specified.
If an order is not accepted, 08TO80 will have you informed without reason within ten (10) days after receipt of the order.

2.3 is entitled to change the contents of the general terms and conditions. Changes will be announced via the website and will take effect 14 days after publication on the website or any other date indicated in the announcement.

Article 3. Prices and Payments

3.1 The stated prices for the products and articles are in Euros' s  including tax and excluding shipping costs, or other levies, unless otherwise stated or agreed in writing.

3.2 Payment must be made (one of) the way(s) indicated during the ordering process. Possible (payment) conditions can be made on your order.
When paying by bank transfer, the date of payment is the date of crediting the bank account of 08TO80. After receiving the payment, only then 08TO80 will deliver the order.

3.3 If the prices of the offered products and services will increase in the period between the order and its execution, you are entitled to cancel the order or the agreement within ten (10) days after notice
of the price increase by 08TO80.

Article 4. Delivery

4.1 The 08TO80 delivery times are only indicative. Late delivery does not entitle you to compensation or the right to cancel your order or the agreement, unless the delay in delivery is such that you can not reasonably be expected to maintain the agreement 
intact. You are then entitled to cancel the order or terminate the agreement when necessary.

4.2 The delivery of the products takes place at the time the products are ready for shipment to you.

Article 5. Ownership
5.1 Ownership of products will only then take place if the account has been paid in full that was agreed upon by 08TO80. The risks regarding the products will be taken over by you only at the time of delivery.

Article 6. Intellectual and industrial property rights

6.1 You must unconditionally respect all the intellectual and industrial property rights attached by the products

6.2 does not guarantee that the delivered products do not infringe any (unwritten) intellectual and / or industrial property rights of third parties.

Article 7. Complaints and Liability

7.1 You have the obligation upon delivery of products to investigate whether the products meet the agreement. If this is not the case, you have to inform 08TO80 as soon as possible in writing within 7 days after delivery and after observation, to give motivated and detailed information about the products.

7.2 If it has been proved that the products do not meet the agreement, 08TO80 can choose to return the products or to replace the products by new products or to refund the invoice value.

7.3 If you have a product you do not wish to purchase for whatever the reason will be, you have the right to return the product within seven (7) days after delivery to Returns are only accepted if the packaging of the product is undamaged and the plastic seal on the package is broken, also applies that the costs for returns are at your expense.

Article 8. Orders/Communication

Article 9. Force Majeure

9.1 In case of force majeure has the right, at its option, to suspend the execution of the order or to terminate the contract without judicial intervention, by notifying you in writing and is not required to pay
any compensation, unless under the circumstances to standards of reasonableness and fairness.

9.2 Force majeure is defined as any failure which can not be attributed to 08TO80 because it is not due to her fault and not under the law, legal act or generally accepted.

Article 10. Complaints

10.1 has a well-publicized complaints procedure and will deal with the complaint under this complaints procedure.

10.2. Complaints about the implementation of the agreement should take place promptly, fully and clearly described and submitted to, after the customer has found the defects.

10.3 The complaints sent to 08TO80 will be answered within a period of 14 days from the date of receipt.
If a complaint requires a longer treatment time, 08TO80 will confirm receipt within 14 days in which confirmation will be indicated when  this complaint will be answered.

Article 11. Miscellaneous

11.1 If you specify a different written address to 08TO80, we will send all the orders to that address, unless you are giving 08TO80 a different address then all your orders will be sent to this address.

11.2 08TO80 is competent to make use of the service of third parties in the execution of your order(s).
